According to translated reports out of South Korea, the Court has rejected SM Entertainment’s (SM) request to toss out the Preservation of Evidence application filed by TVXQ. 

The Court’s decision means that SM will have to fork over all the information to the lawyer(s) representing three members who are having a dispute with the agency.

If you remember, Jaejoong, Junsu and Yoochun submitted an application (Preservation of Evidence) which forces SM to preserve evidence to be used at future hearings in the case. SM wanted the court to reject that application so they wouldn’t have to hand over such documentation to Jaejoong’s, Junsu’s and Yoochun’s lawyers.

The Central District Court followed the law basically saying that since SM is the one in control of the documents, they can’t refused to hand over the information directly related to this case.

The fact which has been drawn up is about legal relationship between the artists and their agency company, and in compliance with law of civil procedure article 2 section 344, the document holder side couldn’t refuse to submit the documents that become object of document submission order assertion from the complainants.

TVXQ are seeking information related to their income and distribution of income which includes contracts, journals, receipts, and accounting books.
