Avex, Avex, Avex. Haven’t they learned anything from the fight between JJY (Junsu, Jejung and Yuchun) and their Korean agency SM Entertainment?  According to translated reports, the answer is no. (And my commentary below will be based on the translated reports. If something changes, I’ll let ya know.)

The news flying all over the internet is that AVEX — the agency many fans including myself thought they could trust to at least give the three members a fair shake — apparently wanted more than the trio could give when they sought to change the terms of their contract with the three members.

Junsu, Jejung and Yuchun are (were?) riding a massive wave of success in the Japanese market with their latest mini-album titled “The…” debuting at #1 on the Oricon WEEKLY charts and moving almost 140,000 copies in the midst of slump in the Japanese market.  Jejung was chosen as the costar in a high profile video for one of the most popular and well known Japanese artists in Japan, Ayumi.  And their LIVE DVD from their ‘Thanksgiving’ concerts in DOME also shot to #1 on the DVD sales chart in Japan.

Through all of this, they never publicly complained about anything. But in actuality, the trio apparently were going through a rough time with AVEX in Japan comparable to the terrible time they are having with SM in Korea.

JYJ Legal Spokesman Slams AVEX

The attorney for the three members has slammed AVEX for  trying to hold the past of their management company’s leader against them.  AVEX was trying to take full control over their schedules and apparently wanted to change how much money AVEX would get.  This whole dust up seemed to occur because they didn’t get what the wanted.  Here’s the report from their legal spokesperson:

In an interview on the 17th, the trio’s legal spokesman and lawyer Lim Sang Hyuk revealed that, “Avex requested changes in the contract that the members found difficult to agree to in clauses regarding topics such as income distribution.”

Lawyer Lim Sang Hyuk also added, “At first, it was agreed that all activities performed by the three members would be scheduled and discussed by both sides, but Avex began asking for this to be changed so that Avex would have sole control of scheduling; Avex also requested additional changes that the trio felt were logically unacceptable”

Regarding Avex pinpointing the history of the head of C-JeS as the main reason for halting activities, Lawyer Lim explained that, “Mr. Baek, the head of C-JeS, willingly volunteered for his company to be excluded from the contract if his criminal record would become a problem, but Avex ignored such a notice,” and “Later, they deemed that it would be difficult to progress normally with Mr. Baek’s background.”

Well now it looks like AVEX isn’t as rosy as we all thought they were.  Here it is folks:

[TRANS] 100917 TVXQ Trio’s Official Statement Regarding Avex’s Decision To Halt JYJ’s Japanese Activities

The TVXQ trio, Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong, released the following official statement regarding Avex’s decision to halt the group’s activities in Japan.

1) The head of C-JeS has no ties to gangs whatsoever.

Though his previous conviction is true, it was not a verdict made regarding any ties with gangs. Avex was fully aware of this fact before their contract with the TVXQ trio was signed, and as this cannot be classified as a breach of the exclusive contract, it cannot become a reason to halt activities or cancel the contract.

Several months ago, Avex requested that C-JeS be excluded from the contract for such reasons, and the TVXQ trio agreed to such a request and actively participated in the discussions regarding the renewal of their contract with Avex in order to ensure that they would have smooth activities within Japan.

However, Avex put forth conditions that were unfair to the trio unlike their previous contract, and when the trio refused to accept such conditions, Avex stated the gang ties of the head of C-JeS as a reason for canceling the contract, and finally released an official notice stating that no more activities would occur.
